These competition terms and conditions apply to the competition "Photo competition to win tickets for two tables in the Schottenhammel festival tent on October 1st at 5:00 PM" ("Competition" or "Competition"). The competition is organized by MGH M\u00fcnchner Gewerbehof- und Technologiezentrumsgesellschaft mbH, Gollierstra\u00dfe 70, Entrance D, 5th floor, 80339 Munich (hereinafter referred to as "MGH" or "we").<\/p>\n

1. Conditions of participation<\/strong><\/p>\n

All persons who are 18 years of age or older at the time of participation and who are resident in Germany are eligible to participate. Participants may only participate in the photo competition if they comply with these terms and conditions. If the participant does not agree to the terms and conditions, they may not participate in the competition. Participation must be submitted by email to redaktion@munich-startup.de<\/a> and via Facebook. Multiple entries by a participant are not permitted. Participation by or via automated competition services is prohibited. MGH employees and their relatives are excluded from participating in the competition. Participation in the competition is free of charge. Participants only have to pay the internet connection fees. Participation is independent of the purchase of MGH products or services for a fee.<\/p>\n

2. Conduct of the competition and drawing of the prizes<\/strong><\/p>\n

The competition starts on Friday, 18 September 2015, at 11 a.m., and participants are invited to submit a photo either to redaktion@munich-startup.de<\/a> or as a comment under a Facebook post. To participate in the competition, the participant must upload or send a photo showing the "Munich Startup Pin." EWe can only accept submissions until Tuesday, 29 September 2015, 4 p.m.<\/span><\/span>Each participant can only enter the competition once. In the case of multiple entries, the first email or post in chronological order will be counted; additional emails will not be considered for the prize draw. A jury composed of editorial staff from the Munich Startup portal will select the eight most compelling submissions from all email submissions. The eight selected participants will each receive two tickets to the Schottenhammel festival tent on October 1st at 5:00 PM. Each participant will also receive a beverage of their choice in the Schottenhammel festival tent. Cash payments are not possible. The tickets will be distributed according to the following prize distribution:<\/p>\n

1st-8th place: 2 tickets each<\/p>\n

Entries submitted after 4:00 PM on September 30, 2015, or by any means other than email or Facebook post, will not be considered for the drawing. The time of receipt of the entry will be determined by the electronically logged receipt of the participant's email. The prize drawing and notification of the winners will take place no later than September 30, 2015.<\/p>\n

3. Winner notification, claiming prizes and forfeiture of prizes<\/strong><\/p>\n

Each participant who is randomly awarded a prize ("winner") will be notified by MGH after the prize draw via a reply to the user's email or Facebook post. In this notification, the winner will be asked to respond to the competition organizer via email to verify eligibility and ensure further prize processing. If the winner does not respond to MGH's notification within two calendar days, the respective prize will be re-drawn among one of the remaining participants.<\/p>\n

4. Transfer of the prize claim and replacement prizes<\/strong><\/p>\n

Cash payment or transfer of the prize claim to third parties is not possible.<\/p>\n

5. Exclusion of participants from the competition<\/strong><\/p>\n

MGH reserves the right to exclude participants who violate these competition terms and conditions or attempt to gain an advantage through manipulation from participation in the current competition and future competitions. In such a case, the prize may be revoked and reclaimed retroactively and awarded to a replacement winner. A participant may be excluded in particular if the participant (i) is not eligible to participate, (ii) has provided incomplete or false information during participation, (iii) has used unauthorized aids or otherwise obtained improper advantages through technical or other manipulation (e.g., scripts for automated participation, viruses, Trojans, manipulation of the application), (iv) has committed fraudulent acts in connection with participation, (v) has violated applicable laws with their participation, or (vi) has attracted attention through other unfair or rule-breaking behavior. The same applies to attempts to commit the aforementioned acts.<\/p>\n

6. Early termination of the competition<\/strong><\/p>\n

MGH may interrupt, cancel, or prematurely terminate the competition at any time without prior notice if malfunctions, disruptions, tampering, viruses, or similar incidents occur that compromise the administration, security, fairness, or integrity of the competition. Participants may not derive any claims from an interruption, cancellation, or premature termination. A corresponding notice regarding the interruption, cancellation, or premature termination of the competition will be published on the organizer's website.<\/p>\n

7. Liability<\/strong><\/p>\n

MGH is only liable for intent and gross negligence or to the extent required by mandatory law.<\/p>\n

8. Exemption<\/strong><\/p>\n

The participant hereby releases MGH and Facebook from any culpable damages caused by or in connection with his participation in the competition.<\/p>\n

9. Data protection<\/strong><\/p>\n

MGH, as the responsible party, collects, processes, and uses the participant's email address as well as the content of the emails or Facebook posts sent by them as part of their participation in this competition. MGH also collects, processes, and uses the names of the winners. This personal data is collected, processed, and used exclusively for the purpose of conducting the competition, notifying the winners, and sending the prize. The photos submitted by the entrants will be shared with participating third parties if they are published as part of the photo competition. The participant hereby expressly consents to this.<\/p>\n

10. Material and legal defects<\/strong><\/p>\n

MGH is not liable for any legal or material defects in the prize.<\/p>\n

11. Exclusion of legal recourse<\/strong><\/p>\n

MGH makes all decisions related to the conduct of the competition at its sole discretion. These decisions are final, conclusive, and irrevocable. Legal recourse is excluded.<\/p>\n

12. Copyrights<\/strong><\/p>\n

The participant affirms that they own all rights to the submitted image, have unrestricted exploitation rights to all parts of the image, that the image is free of third-party rights, and that the depiction of individuals does not violate any personal rights. If one or more individuals are recognizably depicted in the photo, the individuals concerned must consent to the publication of the image. The participant will provide written confirmation of the above upon request. Should third parties nevertheless assert claims for infringement of their rights, the participant indemnifies the organizers from all claims. Computer-edited photos may not contain any image portions from magazines, books, purchased CDs, etc.<\/p>\n

13. Choice of law<\/strong><\/p>\n

The competition is subject exclusively to the laws of the Federal Republic of Germany.<\/p>\n
